Local knowledge
What's different about buying and selling in Georgia
Georgia closings, transfer tax and homestead rules work differently from most states, and the homestead cap changes in 2027.
Closings must involve a Georgia attorney
The Supreme Court of Georgia held in 2003 that closing a real estate sale, or preparing and overseeing the signing of a deed, is the practice of law. A Georgia-licensed attorney has to be involved; a title company or agent can't run the closing alone.
Transfer tax: about $1 per $1,000
Georgia's transfer tax is $1.00 for the first $1,000 of the price plus 10 cents for each added $100, paid before the deed is recorded. The seller owes it by default, but the contract can shift it to the buyer.
Homestead cap: mandatory everywhere from 2027
Homes are assessed at 40% of market value. The 2024 floating homestead exemption (HB 581) limits yearly growth in a homestead's assessed value to inflation, but many local governments opted out. SB 33, signed May 11, 2026, ends the opt-out, so the cap applies everywhere; the capped value resets when a home sells. Buyers should apply for the homestead exemption once they live in the home on January 1.
Income tax: 4.99% for 2026
Georgia's flat personal income tax rate dropped from 5.19% to 4.99% for 2026 (HB 463, signed May 11, 2026, retroactive to January 1), with more cuts possible in later years.
