Local knowledge
What's different about buying and selling in Maryland
Stacked transfer and recordation taxes, a first-time buyer break and a homestead cap that doesn't transfer. What Maryland clients should know.
First-time Maryland buyers pay less transfer tax
The state transfer tax is 0.5%, but on a home sold to a first-time Maryland buyer who will live in it, it drops to 0.25% and the seller pays it. Otherwise recordation and transfer taxes are presumed split 50/50 unless the contract says otherwise.
County taxes stack on top
Every county adds a recordation tax per $500 and many add a transfer tax: for FY 2026, Baltimore City charges $5.00 per $500 plus 1.5%, Prince George's $2.75 plus 1.4%. On a $300,000 Baltimore City sale that's about $3,000 recordation, $4,500 city and $1,500 state transfer tax.
The homestead cap doesn't pass to the buyer
The Homestead Property Tax Credit caps yearly increases in an owner-occupied home's taxable assessment at 10% or less (0% to 10% by county for 2026-27). It ends when the home sells, so the buyer's bill can be higher than the seller's.
Out-of-state sellers face 8.75% withholding
A deed from a nonresident seller can't be recorded without an income tax withholding payment, 8.75% of the total payment for individuals since July 1, 2025.
