Local knowledge
What's different about buying and selling in Louisiana
Louisiana's civil-law system changes how closings and married sellers work. Four things to know, with property tax amendments on the November ballot.
Notaries draft and pass the act of sale
Under Louisiana's civil-law system, notaries can prepare conveyances and other contracts, and an act passed before a notary is an authentic act. Closings are usually built around an act of sale prepared and passed before a notary.
Both spouses must agree to sell a community home
Louisiana is a community property state: both spouses must agree to sell, mortgage or lease community real estate, even if only one is on the title (Civil Code Article 2347).
Homestead exemption covers the first $75,000
The homestead exemption takes the first $7,500 of assessed value (homes are assessed at 10%, so the first $75,000 of market value) off state, parish and special taxes. Owners 65 and older and some disabled owners under an income limit can freeze their assessment; Amendment 9 on the November 3, 2026 ballot would raise that limit.
Flat 3% income tax since 2025
Louisiana replaced its three income tax brackets with a single 3% rate starting January 1, 2025, and raised the standard deduction to $12,500 single.
