Local knowledge
What's different about buying and selling in New York
Attorneys run most New York deals, and the transfer taxes climb with price. What agents should know.
Attorneys usually run the contract and closing
In New York it's standard for buyer and seller to each hire an attorney. Downstate, the seller's attorney usually drafts the contract and holds the down payment in escrow; upstate, the agent often writes the offer and the attorneys approve it. This is custom described by the State Bar, not a law requiring an attorney.
Transfer tax, plus a 1% mansion tax at $1 million
The state transfer tax is $2 per $500 (0.4%), normally paid by the seller. Residential sales of $1 million or more also owe a 1% mansion tax on the full price, paid by the buyer. In New York City, sales of $2 million and up owe additional state taxes on top of the city's own transfer tax.
The seller disclosure form is mandatory
Since March 20, 2024, sellers of 1-4 family homes can't skip the Property Condition Disclosure Statement by giving a $500 credit. The form must reach the buyer before they sign a binding contract, and it now includes flood questions (floodplain status, flood insurance, past claims and flooding).
Income tax: lower brackets being cut
New York has a graduated income tax, and starting in 2026 the rates on lower brackets (taxable income up to $215,400 single or $323,200 joint) are being cut 0.2 points over two years. New York City and Yonkers add their own income tax.
