Local knowledge
What's different about buying and selling in Indiana
Constitutional tax caps, a public sales disclosure form and homestead deductions that change every year through 2031.
Every sale files a public sales disclosure form
Buyer and seller must sign a state Sales Disclosure Form for nearly every sale, with a $20 filing fee, and the county won't record the deed without it. The filed form is a public record (phone and Social Security numbers stay confidential), and buyers can use it to apply for the homestead deduction.
Property tax capped at 1% of value for homesteads
Indiana's constitution caps a homestead's property tax at 1% of gross assessed value, 2% for rentals and farmland and 3% for other property. The 1% cap applies only with the homestead deduction, so a buyer who doesn't file pays at the 2% level.
Homestead deductions are changing through 2031
Under SEA 1-2025 the flat homestead deduction steps down from $48,000 to $0 by 2030 while the percentage deduction rises, and a new credit takes the lesser of $300 or 10% off homestead bills starting in 2026. Since July 1, 2026, keeping a homestead deduction you no longer qualify for costs back taxes plus a 10% penalty.
Flat 2.95% income tax plus county tax
Indiana's income tax is 2.95% for 2026 (2.90% in 2027), and every county adds its own income tax.
